KCAL FM General Contest Rules:
The following are basic contest rules for any and all contests run on KCAL FM:
Each contest may have its own special qualifications and eligibility rules, in which case a separate addendum to these rules will be available.
All KCAL FM contests are open to any listener unless specific age is required by type of contest, participating agency or advertiser or by law. No household can win more than a maximum of 1 prize in any given thirty (30) day period. KCAL FM reserves the right to waive this “30 Day Rule” with regard to any contest. Employees and agents of KCAL FM and all other radio stations located in Riverside, San Bernardino, Los Angeles and Orange Counties and their families, their advertising agencies or representatives are ineligible to enter contests on KCAL FM.
Winners may be required to sign a release, and all winners agree to allow KCAL FM to use their name, voice and/or likeness for promotional purposes without further compensation. All calls coming into KCAL FM are taped and may be aired on KCAL FM without further approval. KCAL FM is not responsible for problems occurring within the telephone system which either inhibit or increase the chances of winning a phone-in contest. In the event two or more phone lines are “tied together” during a phone-in contest, the entire call and all callers “tied together” will be disqualified and another caller will be taken. KCAL FM cannot award duplicate prizes to all parties in a “tied together” situation. In case of telephone line malfunctions, the decision of KCAL FM will be final.
Winners may not request substitution or other consideration from the originally awarded prize. All prizes, unless otherwise stated, must be picked up in person, and signed for by the winner at the KCAL FM business office, located at 1940 Orange Tree Lane, Suite 200, Redlands, CA 92374, any weekday, between 9am and 5pm, within 30 days of winning. Proper photo identification (a valid California driver license or U.S. passport) must be presented for a prize to be claimed. If the value of the prize is equal to or greater than $600.00, a social security card must be presented. Holidays and weekends are included in this 30-day period.
Designated winner’s representatives will be allowed to claim prizes, provided prior arrangements have been made in writing and approved by KCAL FM. If prizes are not picked up within the stated period, the winner waives their rights to the prize and said prize becomes the possession of KCAL FM and may be awarded to another listener at KCAL FM’s discretion. KCAL FM will not notify winners of time remaining on prizes to be picked up. It is solely the winner’s responsibility to claim their prize within the time limit specified. No prize will be mailed unless specified during the contest or if special arrangements have been made in writing with KCAL FM.
Prizes are non-transferable. KCAL FM reserves the right to revoke prizes if the winner does not meet any or all eligibility requirements, even though an announcement may have been made on the air indicating that person was the winner.
A 1099 MISC form will be completed and sent to the Internal Revenue Service for each winner of a prize with a total value of $600.00 or more. All local, state, and federal taxes are the sole responsibility of the winner.
KCAL FM may, due to the unavailability of prizes awarded, substitute another prize of equal or greater value for the prize originally won. KCAL FM will not be responsible, or held liable, for prizes awarded to an event that is cancelled due to circumstances beyond its control. With respect to any disputes regarding contests, the decision of KCAL FM will be final. KCAL FM, its agencies and representatives absolve themselves and shall be held harmless from any action or liability arising from any KCAL FM contest or prize awarded in a contest. All contest entries become property of KCAL FM. KCAL FM may withhold any or all contest materials for any reason it deems crucial to the completion of the contest, or for reasons relating to publicity and/or advertising. Unless otherwise stated, multiple entries by the same person will be discarded and may be deemed cause for disqualification. Additions or deletions to these rules are subject to change without notice.
OFFICIAL ENTRY RULES
Ultimate Summer Roadtrip
Contest is open to California residents at least 18 years of age, except employees and the immediate families of BMW of Riverside, KCAL-FM, SBR Broadcasting, all other Riverside county and San Bernardino county radio stations, or their subsidiaries, divisions, affiliated companies, participating manufacturers and advertising agencies, the determination of which lies solely and exclusively with KCAL-FM. Contest is subject to all federal, state and local laws and regulations and is void where prohibited or restricted by law.
By participating in the Ultimate Summer Roadtrip contest, all entrants agree to these rules in their entirety. Anyone disputing these rules may be disqualified by KCAL-FM. BMW of Riverside and KCAL-FM reserve the right to change these rules at any time.
To participate, listen to KCAL-FM each day between May 14, 2012 and June 29, 2012 to hear the “BMW of Riverside Ultimate KCAL Artist of the Day”. No purchase is necessary to enter. A new BMW of Riverside Ultimate KCAL Artist of the Day will be announced on KCAL-FM each day at approximately 6am, 7am, and 8am. KCAL-FM may also announce the BMW of Riverside Ultimate KCAL Artist of the Day via other communications channels, including, but not limited to, Facebook, the KCAL-FM website located on the Internet at www.kcalfm.com, and emails to the members of KCAL-FM's KCAL Nation listener club, which is free to enter. All such announcements may or may not include clues as to the time(s) at which the BMW of Riverside Ultimate KCAL Artist of the Day will be played.
When any song by the BMW of Riverside Ultimate KCAL Artist of the Day is played in its entirety on KCAL-FM on the date it is announced on KCAL-FM, the 10th caller to (909) 431-4967 at the beginning of the song will qualify to win the “Grand Prize”.
In the event that two telephone lines are tied together during the contest, the entire call will be disqualified and another call will be taken. KCAL-FM cannot award duplicate prizes to both parties in a “tied together” situation, which is a circumstance beyond our control. In case of a dispute over telephone line malfunctions, the decision of KCAL-FM will be final.
The Grand Prize will be awarded at a final event to take place at BMW of Riverside, located at 3060 Adams Street, Riverside, CA 92504 on June 30, 2012 from 1pm to 3pm need time. A random drawing including the names of all qualifiers will be held and one qualifier will be chosen at random as the Grand Prize winner.
Only one Grand Prize will be awarded. In order to receive the Grand Prize, the Grand Prize-winner must qualify for the Grand Prize lease through BMW Financial Services. The Grand Prize consists, in its entirety, of a two-year lease of a 2012 BMW 328i automobile provided by BMW of Riverside, subject to all standard terms and conditions of a similar automobile lease except that the Grand Prize-winner will not be required to pay taxes, and two nights hotel in Big Sur, California, and $100 in cash or gas card, (approximate retail value: $500). As an alternative to the Grand Prize, the Grand Prize-winner may choose, at her or his sole discretion, to refuse to accept the Grand Prize and instead receive a one-time payment of seven thousand five-hundred dollars ($7,500) from BMW of Riverside.
Only one qualifier per household. In regard to KCAL-FM’s “Thirty Day Rule”, this rule is waived for the purposes of the Ultimate Summer Roadtrip contest.
Winners are responsible for all taxes, and other fees related to Grand Prize. Prize is not transferable. Winners will receive their prize within sixty (60) days after the grand prize announcement is made. Odds of winning depend on the total number of entrants. No prize substitution will be made except as may be necessary due to availability.
Official contest rules are available at KCAL-FM studios located at 1940 Orange Tree Lane, Suite 200, Redlands, California 92374. KCAL-FM may, due to availability of prizes awarded, substitute another prize for the approximate value (in dollars) of the original prize awarded.
In the event of a dispute, the decision of KCAL-FM is final. Winners are solely responsible for their own actions and agree to hold harmless BMW of Riverside, KCAL-FM, all contest sponsors/prize providers, and their subsidiaries, divisions, related companies, officers, directors, employees, and agents from any liability arising in connection with their participation and use of prizes. Winner and other participants consent to the use of their name, voice, and/or likeness for publicity purposes in connection with the contest without prior approval or compensation by BMW of Riverside, KCAL-FM and all contest sponsors/prize providers.
